1. Agreement to These Terms

These Terms of Service (“Terms”) form a legally binding contract between you (“User,” “you,” or “your”) and Bek Apps, LLC (“Bek Apps,” “we,” “us,” or “our”). By accessing or using any website, SaaS platform, mobile application, workflow-automation tool, AI-powered feature, API endpoint, or other product or service we provide (collectively, the “Services”), you confirm that you have read, understood, and agreed to be bound by these Terms and all referenced policies (including our Privacy Policy, Cookie Policy, and any service-specific guidelines). If you do not agree, do not access or use the Services.

2. Company Information

Bek Apps, LLC is a limited-liability company organized under the laws of the State of Delaware with its principal office at 1111B S South Governors Ave 29063 Dover, DE, 19904 USA. We operate or make the Services available in the United States and all Member States of the European Union.

3. Eligibility & Account Registration

a) Age & Capacity. You must be at least 18 years old and have the legal capacity to enter into contracts.
b) Account Information. When creating an account you must provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your login credentials and all activity under your account.
c) Representations. By using the Services, you represent that: (i) you are not subject to any U.S. or EU sanctions or export-control restrictions; (ii) you will comply with all applicable laws and regulations; and (iii) you will not use the Services for any illegal or harmful purpose.

4. Scope of Services

The Services include (i) subscription-based SaaS platforms, (ii) downloadable or cloud-hosted mobile and desktop applications, (iii) workflow-automation tools and APIs, and (iv) AI-powered features that generate or transform data. Some components—such as one-time token bundles, custom integrations, and AI inference jobs—are delivered immediately and cannot be reversed once provisioned (“Irreversible Work”). We host primary infrastructure on Amazon Web Services (AWS) in the United States, with optional EU region data storage where identified.

5. Limited License

Subject to these Terms, Bek Apps grants you a revocable, non-exclusive, non-transferable, and non-sublicensable license to (i) access and use the online portions of the Services via a web browser or officially-supported client, and (ii) install and use one copy of any mobile or desktop application solely on devices you own or control, for your internal business or personal purposes. All rights not expressly granted are reserved.

6. Acceptable Use & Restrictions

You agree not to: (a) copy, modify, reverse-engineer, decompile, disassemble, or create derivative works of the Services; (b) interfere with security-related features or circumvent rate limits, authentication, or usage caps; (c) upload viruses or malicious code; (d) use the Services to violate the intellectual-property or privacy rights of others; (e) access the Services for the purpose of building a competing product; (f) use automated scripts or scraping except as expressly permitted by an official API license; or (g) engage in any activity that could disable, overload, or impair the Services.

7. User Content

a) Ownership. You retain ownership of all data, text, files, and other content (“User Content”) that you submit or upload to the Services.
b) License to Bek Apps. You grant us a worldwide, non-exclusive, royalty-free license to host, store, process, transmit, display, and otherwise use your User Content solely for (i) providing, maintaining, and improving the Services, and (ii) complying with legal obligations.
c) Responsibility. You are solely responsible for your User Content and represent that you have all rights necessary to grant the foregoing license.

8. Fees, Billing, Taxes & Payment

a) Pricing. Current pricing and subscription tiers are displayed at the point of purchase or in your account dashboard.
b) Payment Processor. All payments are processed by Stripe on our behalf. You authorize Stripe to charge your selected payment method for all applicable fees, including any recurring subscription charges.
c) No-Refund & No-Chargeback Policy. All sales are final. Because many Services involve Irreversible Work or instant digital consumption, we provide no refunds, cancellations, or credits except where required by mandatory law. You expressly waive any right of withdrawal under EU Directive 2011/83/EU once digital content delivery begins. You agree not to initiate chargebacks; doing so constitutes a material breach, and we may suspend your account, refer the debt to collections, and recover associated costs.
d) Auto-Renewal. Subscriptions renew automatically at the end of each billing period unless you cancel before renewal. You may cancel at any time in your account settings, with service continuing through the end of the paid term.
e) Taxes. Fees are exclusive of VAT, GST, sales, use, or other taxes. You are responsible for all taxes associated with your use of the Services, excluding U.S. taxes based on Bek Apps’ net income.

9. Trials, Betas & Promotional Credits

a) Trials. If offered, free or discounted trials convert to paid plans at the then-current rate unless canceled before the trial ends.
b) Beta Services. Beta or pre-release features are provided “as is,” may be discontinued at any time, and are excluded from service-level commitments.
c) Credits. Promotional credits expire as stated in the offer terms and have no cash value.

10. Service Availability, Maintenance & Support

a) Availability. We strive for 99.5 % monthly uptime but do not guarantee uninterrupted service.
b) Maintenance. Scheduled maintenance may occur, typically with at least 24 hours’ notice posted on our status page. Emergency maintenance may occur without notice.
c) Support. Standard support is provided via email at hello@bekapps.com during U.S. business hours (Mon–Fri, 09:00–18:00 ET). Priority or SLA-backed support is available on certain paid plans.

11. Data Protection & Privacy

Our Privacy Policy explains how we collect, use, and safeguard “personal data” as defined under the EU General Data Protection Regulation (“GDPR”) and the California Consumer Privacy Act (“CCPA”). Key points include:
• Lawful Bases: consent, contract performance, legitimate interest.
• Data Subject Rights: access, deletion, correction, portability, objection, restriction.
• Sub-processors: Stripe (payments), AWS (hosting), and other vetted providers listed in our Privacy Policy.
• International Transfers: Standard Contractual Clauses or other approved safeguards apply when we transfer personal data outside the EEA/UK.

12. Security

We implement industry-standard administrative, technical, and physical safeguards to protect your information. However, no method of transmission or storage is 100 % secure, and we cannot guarantee absolute security.

13. Third-Party Services & Links

The Services may contain links to third-party websites or integrate with third-party tools (e.g., Stripe, Google Analytics). We are not responsible for third-party content, privacy practices, or service failures.

14. AI-Generated Output Disclaimer

AI-generated content, insights, or recommendations are provided “as is” for informational purposes only. You remain solely responsible for verifying accuracy and appropriateness before relying on or publishing any AI output.

15. Intellectual Property

a) Bek Apps IP. All software, documentation, trademarks, logos, and other materials provided by Bek Apps are our exclusive property, protected by U.S. and international IP laws.
b) Feedback. You may submit ideas or suggestions regarding the Services (“Feedback”). By submitting Feedback, you grant us a perpetual, irrevocable, royalty-free license to use it without restriction.

16. DMCA & Copyright Policy

We respond to valid Digital Millennium Copyright Act (“DMCA”) takedown notices. If you believe content hosted on the Services infringes your copyright, please send a notice to hello@bekapps.com with the information required by 17 U.S.C. § 512(c)(3).

17. Disclaimers

a) The Services are provided “as is” and “as available,” without warranties of any kind, express or implied.
b) We disclaim all warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade.
c) We do not warrant that the Services will be error-free, uninterrupted, or secure, or that data loss will not occur.

18. Limitation of Liability

To the fullest extent permitted by law, Bek Apps shall not be liable for any indirect, incidental, special, consequential, or punitive damages; loss of profits, revenue, data, or goodwill; or service interruption or system failure, even if advised of the possibility. Our aggregate liability for all claims in any 12-month period shall not exceed the greater of (i) amounts you paid to Bek Apps in that period or (ii) USD 100.

19. Indemnification

You agree to indemnify and hold harmless Bek Apps, its officers, directors, employees, and agents from any claim, demand, or loss arising out of (i) your use of the Services, (ii) your User Content, or (iii) your violation of these Terms or applicable law.

20. Governing Law & Venue

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles. Any dispute arising from or related to the Services shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to such jurisdiction and venue.

21. Export Compliance & Sanctions

The Services may be subject to U.S. export-control laws and EU sanctions regulations. You agree not to export, re-export, or transfer any portion of the Services to prohibited destinations or persons.

22. Force Majeure

We are not liable for failure or delay in performance caused by events beyond our reasonable control, including natural disasters, war, terrorism, civil unrest, labor disputes, or Internet service disruptions.

23. Assignment

You may not assign or transfer these Terms without our prior written consent. Bek Apps may assign these Terms freely as part of a merger, acquisition, or sale of assets.

24. Entire Agreement & Severability

These Terms, together with all referenced policies, constitute the entire agreement between you and Bek Apps regarding the Services and supersede all prior agreements. If any provision is held invalid, the remaining provisions will remain in full force.

25. No Waiver

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

26. Changes to Terms

We may update these Terms from time to time. Material changes will be posted on our website or emailed to you. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
